This Digital Asset & Risk Disclaimer ("Disclaimer") governs the use of the web interface, platform, and observation tools located at https://kapexpay.com (the "Platform"), operated by Kapex Pay DAO LLC ("Company", "we", "us", or "our"), a Decentralized Autonomous Organization Limited Liability Company formally registered under the laws and regulations of the Catawba Digital Economic Zone (CDEZ), North Carolina, United States.
Kapex Pay DAO LLC is a technology infrastructure provider. The Company is not a bank, depository institution, credit union, or traditional financial services provider. The Platform is currently operating in a secure, non-custodial, and PRE_OPERATIONAL state. We do not accept fiat or cryptocurrency deposits, we do not issue credit, nor do we manage client investment portfolios. No content provided on the Platform constitutes financial, investment, legal, or tax advice.
The Platform is currently PRE_OPERATIONAL and does not execute digital asset transactions, stablecoin settlement, public mainnet activity, exchange, off-ramp, custody, withdrawals, or external funds movement. If and when digital asset capabilities are authorized in a future phase, such activity may involve external blockchain networks, regulated providers, or third-party infrastructure outside the direct control of Kapex Pay DAO LLC. Digital asset transactions, once authorized and executed through approved infrastructure, may involve irreversibility, network risk, protocol risk, de-pegging risk, smart contract risk, and regulatory risk.
The Platform operates on an audit-only/observation basis. Kapex Pay DAO LLC does not hold, store, manage, or maintain custody of any user’s private keys, seed phrases, cryptographic credentials, wallets, or digital assets. No production wallet routing, signing, custody, withdrawal, exchange, off-ramp, or mainnet capability is enabled. If future authorized functionality requires interaction with wallets or digital asset infrastructure, users will remain responsible for wallet security and any additional terms, provider rules, legal approvals, and go-live controls then applicable.
Digital assets are subject to extreme market volatility. Stablecoins may seek to maintain a 1:1 peg with fiat currencies, but they can be affected by technological, systemic, liquidity, issuer, custody, market, and regulatory risks. Kapex Pay does not currently offer live stablecoin settlement, custody, exchange, off-ramp, or mainnet services. Any future authorized digital asset functionality would require separate review, disclosures, provider controls, and formal activation.
Kapex Pay DAO LLC is registered under the progressive regulatory framework of the Catawba Digital Economic Zone (CDEZ) and its operational roadmap incorporates admission into the CDEZ Regulatory Sandbox. Regulatory frameworks governing digital assets, decentralized autonomous organizations, and fintech platforms are highly dynamic and subject to change at the state, federal, and international levels. Future legislative or regulatory actions may impact, restrict, or modify the operational availability of the Platform.
